Information on data protection regarding the processing of applicant data 

Dear applicants 

We are pleased that you are interested in us and that you are applying or have applied for a position at CARBOGEN AMCIS. We would like to provide you below with information on the processing of your personal data in connection with the application. 

Please read this document carefully. By proceeding with your application, you agree to the following privacy policy ("Privacy Policy"). 

1. Identity of the responsible person 

"CARBOGEN AMCIS" refers to CARBOGEN AMCIS AG & CARBOGEN AMCIS INNOVATIONS AG.

2. Purpose and scope of processing 

We store all data that you provide to us in connection with your application and that helps to facilitate the application, selection and hiring process. This includes, among other things, your contact details, your application documents (CV, cover letter, previous work experience, education and certificates as well as our notes from interviews with you), your desired salary, the type of employment you are seeking and the date available. In addition, this also applies to any other data you provide to us, including any correspondence you have with us during the application process. 

We may also obtain the above data about you from other sources, in particular personnel service providers, the references you provide to us, websites and other publicly accessible data on the Internet. This includes, for example, data that you have obviously made public as part of an online profile. We may also receive data that you provide to us via third-party websites, e.g. from job boards such as jobs.ch or Indeed. 

We process your data, 

  • to enable application, selection and recruitment processes and to support internal job changes as part of our pre-contractual measures (Art. 6 para. 1 lit. b DSGVO), 
  • to contact you on the basis of our legitimate interest in the context of surveys relating to our employer presence and recruitment process (Art. 6 para. 1 lit. f DSGVO), 
  • to inform you about future vacancies based on your consent and to check the suitability of your application for other positions that match your profile (Art. 6 para. 1 lit. a DSGVO). You can withdraw this consent at any time. 
  • to fulfill legal obligations (Art. 6 para. 1 lit. c DSGVO). 

3. Legal basis of data processing 

The legal basis for the processing of your personal data in this application process is the Data Protection Act of Switzerland ("DPA") and, if applicable, the EU General Data Protection Regulation (2016 / 679) ("GDPR"). 

4. Recipient of the data 

Your application will be received by CARBOGEN AMCIS and will only be processed and forwarded within the company for the purposes stated. After receipt of your application, your data will be viewed by the personnel department and the department managers for the respective open position. Within CARBOGEN AMCIS, only those persons have access to your data who need this data for the proper processing of our application procedure and the applicant portal. 

If you consent to the processing of your data within the framework of the CARBOGEN AMCIS talent pool, your declaration of consent will result in us storing your data in our talent pool. In the event that your application is considered for another vacant position at CARBOGEN AMCIS, we will forward your application documents to the respective department and, if necessary, subsequently contact you by telephone or e-mail. 

The data will not be passed on to third parties outside the company or used for other purposes. This does not include the use of data in anonymized form for statistical purposes (e.g. reporting). In this case, it is not possible to draw conclusions about individual persons. 

5. Duration of storage 

In principle, your data is stored for as long as it is necessary for the purposes described above. 

Data of applicants will be deleted in case of rejection within 6 months after the rejection has been issued. If we have received your application via a personnel service provider, we will store your surname, first name, date of birth and e-mail address for a further 24 months. 

In the event that you have consented to further storage of your personal data, we will transfer your data to our talent pool. Unless you expressly give us renewed consent to process your data, your data will be deleted in full no later than 24 months after you have given your consent. 

If you are awarded a position during the application process, the data from the applicant data system will be transferred to our HR information system. 

To ensure legal requirements, data may be stored beyond the specified periods. 

6. Your rights as a person affected by data processing 

Right of objection

According to Art. 21 DSGVO, you have the right to object to the processing of data that has been or will be collected on the basis of your consent (Art. 6 lit. f DSGVO) at any time for reasons arising from your particular situation. If you exercise your right to object, your data will not be further processed unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves, for example, to assert, exercise or defend legal claims. 

Furthermore, you are free to withdraw your application and thus your consent pursuant to Art. 6 lit. a DSGVO at any time. In this case, we undertake to delete your data in accordance with the above-mentioned deadlines (see "Duration of storage "). 

Right of withdrawal in the case of consent 

Insofar as the data processing is based on your consent, you have the right to revoke the consent at any time. This also applies to the revocation of declarations of consent that you gave us before the DSGVO came into force on May 25, 2018. The revocation of consent is for the future and does not affect the lawfulness of the data processed until the revocation. The withdrawal of consent can be made by email to datenschutz@carbogen-amcis.com. Alternatively, you can choose any other way to notify us of the withdrawal of consent. However, you must prove your identity with two factors. 

Further data protection rights 

In addition to your right of objection and revocation, you have, in accordance with the provisions of the GDPR, in particular a right to information (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR) and right to restriction of processing (Art. 18 GDPR). 

7. Validity of the privacy policy of CARBOGEN AMCIS 

The text in this Privacy Policy is subject to change. If we make changes, we will notify you at least 30 days before the change takes effect.
